Terms of service

These terms apply to anything you buy from Infinium Research Inc., a company registered in Vancouver, British Columbia, Canada ("we", "us"), and to your use of infiniumresearch.net.

1. What we sell

• Consulting services. App consulting (App Store audits, rejection rescue, submission and launch) and search consulting. Each service, what it includes and its starting price is described on its page.
• Apps. Our iPhone and iPad apps are sold through Apple's App Store. Apple is the seller of record for app downloads, subscriptions and in-app purchases, and Apple's terms apply to those purchases.

We do not sell physical goods, and nothing is shipped.

2. Prices

Prices are in US dollars. The prices on our service pages are starting prices. Before any work starts, we confirm the scope and a fixed fee in writing, and that fixed fee is the amount you pay. There are no retainers, subscriptions or recurring charges for consulting services.

3. Payment

Consulting fees are payable in advance, before work begins, unless your invoice sets out a payment schedule. You pay by the invoice or secure payment link we send you, or by bank transfer. Card payments are processed by our payment provider. We never see or store your full card number.

Card payments appear on your statement under the descriptor shown on your invoice.

4. How services are delivered

All services are delivered electronically. Written reports and findings are sent by email. Calls are held by video or voice at a time agreed in advance. Builds, submissions and configuration changes are made in your own accounts, and we confirm by email when they are complete. Delivery times are stated in writing for each engagement.

5. The engagement agreement

Every consulting engagement is covered by our Consulting Engagement Agreement, which you accept before paying. If anything in these terms conflicts with that agreement, the agreement governs the engagement.

6. Cancellation and refunds

You can cancel before work begins for a full refund. The complete rules are in our refund policy.

7. No guarantee of outcome

Apple decides whether an app is approved, and search engines decide how pages rank. We cannot guarantee either outcome, and we do not claim to. What we do commit to is set out on each service page and in the engagement agreement.

8. Problems and disputes

If something is wrong, email us at support@infiniumresearch.net first. We respond to every concern within two business days and will try to put it right. Please give us that chance before contacting your card issuer or payment provider.

9. Liability

Our total liability for any service is limited to the fees you paid for it. We are not liable for indirect or consequential loss, including lost profit, account closures, app removals or ranking changes made by third parties. Nothing here limits liability that cannot be limited by law.

10. Governing law

These terms are governed by the laws of British Columbia, Canada. The courts of British Columbia have jurisdiction, and either party may use a small-claims court where one is available.

11. Changes

We may update these terms. The date at the top shows when they last changed. The terms in force when you paid apply to that purchase.
